1.46 million Shekels fine for employing migrant workers in sub-standard conditions by: Avi Shauli, Ynet (Jan. 30, 2007)
A fine of 939, 600 Shekels was imposed on the company "Nir & Cohen vegetables" and each of its managers, Shlomo Cohen and Ofer Liberman was ordered to pay 261,000 Shekel fine or spend a year in prison.
The indictment was filed by Atts. Anat Shimoni and Yael Miller from the legal department of the Ministry of Industry, Trade and Labor without imposing first an administrative fine due to the sub-standards living conditions that were supplied by the defendants to their employees. The living quarters consisted of a heap of cardboard and wood plates covered with nylon, unfit for human living, without beds and bed linen, and no closets, kitchen, toilets, showers, running water or light, as demanded by law.
The defendants employed workers without legal permission, with no medical insurance, without a written work contract and without giving payslips. The defendants did not admit to counts of the indictment. The company and its two managers were ordered to pay the maximal fine that can be given for violating the migrant workers law.
The decree given by the judge Ilan Sofer of the Beer Sheva regional labor court stated: "employing any worker unlawfully is a violation of the law in itself, and the same goes to the employing without work contract, employing without insurance… that is the language of the law and its purpose. The migrant workers reach Israel after they paid high sums to brokers, manpower agencies that earn easy money on their back… the workers are exposed to abuse, exploitation and oppression and the living conditions they are offered are sub-standards."
