Precedent: Palestinian injured at work in a settlements recognized by Israeli National Insurance by: Kav LaOved
A Palestinian worker, resident of the village of Haras in the West Bank, was injured while working in an Israeli factory in the industrial area Barkan. The worker approached Kav LaOved so that we help him file a claim with the National Insurance Institute for the loss of his ability to work. To begin with the case was transferred to a lawyer working with Kav LaOved, but since it was difficult to obtain medical evaluations and certificates from the National Palestinian authority's medical committee, the case was transferred back in to Kav LaOved.
After a long struggle on our part the worker received recognition for 90 days of loss of ability to work, which enabled him to file a claim for financial support. The worker’s Israeli employer eventually agreed to sign the form, when it was made clear to him that the National Insurance regulations apply to Palestinian workers working in settlements in case of an industrial accident.
On January 31, 2008, the claim was filed with the National Insurance Institute and in May the worker was informed by phone that a sum of 12,600 shekels had been transferred to his bank account from the National Insurance Institute. Now all that is left is to claim the money for the medical expenses the worker had until he was recognized by the NII, and request a meeting with the medical committee in order to determine his permanent disability level.
